The practical rules for using Nightflat.
These terms explain who operates Nightflat.com, how the music service may be used, how payments are handled, and what keeps the listening space fair and reliable.

Nightflat.com is operated by Madeliz.
Nightflat.com is a music service operated by Madeliz, registered with the Dutch Chamber of Commerce under KvK number 77510194, The Netherlands.
When these terms say "Nightflat", "we", "us", or "our", they refer to the Nightflat.com service operated by Madeliz.
Service
Nightflat is for personal listening.
Nightflat provides moody music, rooms, playlists, profiles, and related listening features for private focus, sleep, rest, study, and similar personal use.
You may use the service only in a lawful, respectful way and only through the website, player, and features that Nightflat makes available.
Accounts
Keep your account honest and secure.
You are responsible for the information you provide, the activity on your account, and keeping your login details private. Do not impersonate another person, create misleading profiles, or use automated signups.
We may limit, suspend, or remove accounts that abuse the service, disrupt other listeners, break these terms, infringe rights, or create legal, security, or operational risk.
Music rights
Listening does not transfer music rights.
Music and related creative materials on Nightflat remain protected by copyright and other rights. Listening through Nightflat does not give you ownership, download, resale, broadcast, remix, sampling, public performance, or redistribution rights.

Platform content
Music and content
Nightflat provides atmospheric music streams, playlists and related audio content for relaxation, focus and late-night listening.
The music available on Nightflat is original content created with modern production tools, then selected, reviewed and curated by Nightflat.
Artist names, artist pages, profile details, and Artist Pulse updates are part of Nightflat's creative world. They are presented as a work of fiction and are meant to make the listening room feel warmer, more social, and more fun to interact with.
Nightflat does not intentionally publish music that copies existing artists, songs, lyrics, melodies or protected works. Tracks are chosen for their mood, atmosphere and listening experience.
If you believe that any content on Nightflat infringes your rights, you may contact us so we can review the material and take appropriate action where needed.
Fair use
Use Nightflat in a fair and normal way.
Nightflat may apply fair-use limits to streaming, bandwidth, requests, rooms, playlists, accounts, or other features so the service stays stable for everyone.
The current daily audio fair-use limits are 150 MB for guest Visitors, 1 GB for registered Visitors, 1.5 GB for Residents, 3 GB for Night Owls, and 5 GB for Rooftop members. Song counts shown in the player and pricing page are estimates based on the current library average.
Do not bypass limits, scrape audio or metadata, share signed stream URLs, overload the service, resell access, or use Nightflat as background infrastructure for another product, venue, public stream, automation, dataset, or commercial service.
Flat Coins
Flat Coins are earned by real listening.
Flat Coins are Nightflat's in-site reward currency. Logged-in listeners can earn them while music is actively playing through the Nightflat player or a shared room.
Listening progress is saved in small steps and turns into whole Flat Coins over time. Visitor accounts earn at the normal 1.0x rate. Resident earns at 1.2x, Night Owl at 1.5x, and Rooftop at 1.8x.
Daily limits, active-playback checks, and anti-abuse limits may apply so the economy stays fair. Flat Coins are not money, cryptocurrency, stored value, or a withdrawable balance, and they cannot be sold, exchanged for cash, or transferred outside Nightflat.
Flat Coins may be used for Nightflat features such as room or space items when those features are available.
Payments
Paid features may be processed by Mollie.
If Nightflat offers paid features, payments may be processed by Mollie. Payment methods, transaction handling, refunds, chargebacks, fraud checks, and payment availability may be subject to Mollie's applicable terms, payment-method rules, security checks, and legal requirements.
You must provide accurate payment and billing information, use payment methods lawfully, avoid chargeback abuse, and cooperate with reasonable checks needed to prevent fraud, money laundering, payment misuse, or other illegal activity. Mollie's legal information is available at mollie.com/legal.
Refunds and access
Paid access depends on successful payment.
Paid features, if introduced, become available only after successful payment confirmation and may depend on the plan, period, feature description, and technical availability shown at checkout.
We may correct pricing or availability mistakes, refuse suspicious transactions, reverse access after failed or refunded payments, and handle refund requests according to the feature description, applicable consumer law, payment-provider rules, and these terms.
Privacy and GDPR
We keep data protection in mind.
Nightflat aims to handle personal data with GDPR principles in mind, including data minimisation, security, purpose limitation, and respect for user rights where they apply.
We may process account data, session data, listening activity, fair-use data, technical logs, payment status information, and support messages to operate the service, secure accounts, prevent abuse, provide features, handle payments, and meet legal obligations. Payment details may be handled directly by Mollie or the selected payment method provider.
Availability
The service may change over time.
Nightflat is provided with care, but we do not guarantee uninterrupted availability, permanent access to every feature, or that every track, room, playlist, account feature, or payment method will always remain available.
We may update, pause, limit, remove, or improve parts of the service when needed for maintenance, security, legal compliance, licensing, abuse prevention, or product development.
Liability
Use Nightflat at your own discretion.
Nightflat is a listening and music service. To the fullest extent allowed by law, we are not liable for indirect loss, lost profits, business interruption, data loss, device issues, third-party service failures, or misuse of the service by others.
Nothing in these terms limits liability where it cannot legally be limited, including liability for intent, deliberate recklessness, or rights that mandatory consumer law protects.
Legal basis
Dutch law applies.
These terms are governed by the laws of The Netherlands, unless mandatory consumer protection rules require otherwise.
If a part of these terms is invalid or unenforceable, the rest stays in effect. We may update these terms when the service, payment setup, legal requirements, or fair-use needs change.
